Terms & Acceptable Use

Last updated July 2026

Draft — not yet in effect. This strengthened draft is under review by counsel before hammering.ai's public launch. The contracting entity, governing law, and liability cap below are placeholders to be finalized with counsel; nothing here is legal advice.

By using hammering.ai (the "service") you agree to these terms. If you don't agree, don't use the service.

Who can use it

You must be at least 18 and able to form a binding contract to use the service. If you use it for an organization, you represent that you can bind that organization to these terms.

Authorization is required

You may only scan a site that you own or are explicitly authorized to test. This is the box you check before every scan, and it is a real commitment. By running a scan you represent and warrant that you own the target or have current, explicit authorization from its owner to test it.Scanning property you don't control may violate computer-misuse laws (such as the US CFAA or the UK Computer Misuse Act). You are solely responsible for having authorization.

Acceptable use

Don't use the scanner to attack, overwhelm, or gain unauthorized access to any system; don't attempt to bypass or defeat the ownership gate on the deep database check; don't run automated high-volume, destructive, or denial-of-service-style requests through the service; and don't use it to harm a competitor or any third party. We may rate-limit, suspend, or block any use we consider abusive.

The results are not a guarantee

A clean scan is a fast, outside-in first pass — nota guarantee of security and not a penetration test. It only sees what an unauthenticated visitor's browser can; it can't see anything behind a login, business-logic flaws, or your infrastructure. A high score means we didn't find these specific external issues — not that you have none. Treat every result as a signal, not a certification.

No warranty

The service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty of the accuracy or completeness of results. We do not warrant that the service will find every issue, that a high score means you are secure, or that it will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law: (a) hammering.ai and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business interruption, arising out of or relating to the service or your reliance on its results — whether in contract, tort, or otherwise, and even if we were advised of the possibility; and (b) our total aggregate liability for all claims relating to the service will not exceed one hundred US dollars (US$100) [cap to be confirmed with counsel]. Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless hammering.ai and its operators from any claim, demand, loss, or expense (including reasonable legal fees) arising out of or related to: (a) your use of the service; (b) any scan you ran without authorization from the target's owner; (c) your breach of these terms or the acceptable-use rules; (d) your violation of any law or the rights of any third party; or (e) any system or content you direct the service to test.

Scores, badges & "verified" results

A hammering.ai score, badge, or "verified" result reflects specific external checks at a single point in time. It is not a certification, an audit, or a guarantee of security. No one — including anyone who sees a badge you display — should rely on it as a representation that a system is secure or free of issues. You may display a badge for a scan you actually ran; you may not alter it, misrepresent it, or imply certification.

No high-risk use

The service is a lightweight, best-effort tool. Don't rely on it as the sole safeguard for any system where a failure could contribute to death, personal injury, or severe environmental or financial harm.

Changes

We may change, suspend, or discontinue the service at any time, and may update these terms. Material changes will be posted on this page. Continuing to use the service after a change means you accept it.

Contracting entity & governing law

The legal entity that operates hammering.ai, and the governing law, jurisdiction, and venue for these terms, are being finalized with counsel and will be stated here before public launch. [entity, governing law & venue — to be set by counsel] Until then, these terms are a draft and not in effect.

General

If any provision of these terms is held unenforceable, the rest remains in effect (severability). These terms are the entire agreement between you and us about the service and supersede any prior understanding. Our not enforcing a provision is not a waiver of it. You may not assign these terms; we may assign them to a successor (for example, in a merger or sale of the service).

Reporting abuse

If your site was scanned without authorization, or to report misuse, email abuse@hammering.ai and we'll block the target.
